DiscoClocker Terms of Service

These Terms of Service ("Terms") set out the conditions under which DiscoClocker (the "Service") is provided. Users (both administrators and general members) may use the Service only after agreeing to these Terms.

Article 1 (Application)

These Terms apply to all provision and use of the Service. A contract for the Service is formed once an administrator agrees to these Terms.

Article 2 (Registration)

  • Administrators register for the Service using a Discord account.
  • Administrators must register billing information and are responsible for managing the payment method.
  • User information is obtained through Discord.

Article 3 (Account management)

  • Users are responsible for properly managing their own Discord account.
  • The Service is not liable for damages arising from inadequate account management.
  • Administrators are responsible for the conduct of all general users who use the Service under their account.

Article 4 (Service content)

The Service provides attendance recording and management functionality operated through a Discord bot. The content provided may change for the purpose of improvement.

Article 5 (Fees and payment timing)

  • The Service is provided as a monthly subscription.
  • Fees are charged automatically via Stripe at the start of each billing period.
  • The number of seats under contract is based on the settings configured by the administrator.
  • Fees already paid are non-refundable.
  • Adjustments to fees resulting from changes in the number of contracted seats are reflected at the next billing cycle, based on Stripe's calculation.

Article 6 (Billing and payment failure)

  • If payment continues to fail for a certain period, use of the Service may be restricted or suspended.
  • Administrators must promptly update their payment method.

Article 7 (Cancellation)

  • Administrators may cancel at any time from the dashboard.
  • The Service remains available until the end of the current billing period after cancellation.
  • Provision of the Service ends on the last day of the billing period.
  • No refund is given for fees already paid, even if cancellation occurs partway through a billing period.
  • No further charges are made after the end of the billing period.

Article 8 (Prohibited conduct)

Users must not engage in any of the following:

  • Unauthorized use, tampering, reverse engineering, or interference with the Service
  • Conduct that violates Discord's Terms of Service
  • Conduct that violates any law or public order and morals
  • Impersonating another person

Article 9 (Handling of data)

  • Attendance data and user data are used for the purpose of providing and improving the Service.
  • Personal information is managed appropriately and is not provided to third parties except as required by law.
  • The retention period and deletion method for attendance data after cancellation are determined by the provider.
  • Whether and how data is made available after cancellation is determined by the provider.

Article 10 (Suspension or interruption of the Service)

  • The Service may be interrupted or suspended due to system maintenance, failures, or outages of external services (such as Discord or Stripe).
  • The Service is not liable for any damages arising from such suspension.
  • The Service does not guarantee any specific uptime or availability.

Article 11 (Disclaimer)

  • The Service is not liable for any damages arising from use of the Service.
  • The Service is not liable for damages arising from failures of external services or changes to their APIs.
  • The Service is not involved in disputes between users.
  • The Service is an aid to attendance management and does not guarantee the accuracy or completeness of recorded data.

Article 12 (Copyright and intellectual property)

Intellectual property rights in the logos, text, functionality, and other elements of the Service belong to the provider. Unauthorized reproduction or republication is prohibited.

Article 13 (Changes to these Terms)

These Terms may be changed as necessary. Administrators will be notified of any material changes.

Article 14 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the provider as the court of first instance.

Article 15 (Exclusion of antisocial forces)

Users warrant that they do not fall under the category of antisocial forces.
